Day four concluded with closing arguments, where defense attorney Timothy Bradl argued that Kelsey Fitzsimmons was in the middle of a suicide attempt, while prosecutor James Gubitose argued the firearm evidence proved she intentionally pointed the gun at Patrick Noonan. Judge Jeffrey T. Karp found Fitzsimmons not guilty, ruling that the Commonwealth had not proven beyond a reasonable doubt that she intentionally assaulted Noonan. In delivering the verdict, Karp said the evidence left too much uncertainty about whether the gun was aimed at police or at Kelsey herself, making reasonable doubt decisive.
